Today's grats: Judge Walker overturned Prop 8!

Probably somewhat odd to be grateful for this from CT, where we've had same sex marriage for almost two years, but I'm happy about this nonetheless and grateful to Judge Walker for this ruling. It will undoubtedly be appealed, and a stay has already been granted pending appeal, so no same sex marriages in CA yet, but this was an important ruling and an important step.


Now, could somebody please de-confuse me about the appeals process? I've heard both that the next step of appeals is to the 9th Circuit Court and then the US Supreme Court and that Judge Walker is on the 9th Circuit Court, so the next step from here is the USSC with no intermediate court of appeal. I'm no legal expert, but I'm pretty sure both of those things cannot simultaneously be true. Thanks to [profile] amydmartin for the clarification: Walker is a district court judge, so the next step for an appeal would be the 9th Circuit.

Why even if you have all the legal documents you "should," it's no guarantee that will be enough. Thanks to [personal profile] juniperus for the link.

The other big thing that a friend of mine once pointed out is that if your marriage is not recognized at the federal level, and one of you dies, the other partner could lose your home just due to taxes that would be waived or lowered (I forget which, and that's something I ought to rectify) for a recognized spouse to inherit. Federal taxes, ergo only federal recognition means anything.

So yeah, this needs to be resolved at the federal level. Meanwhile, I've just RSVP'ed to join the Love Makes a Family one year anniversary celebration of equal marriage rights in Connecticut, because while it's not enough, it's a very important step in the right direction.
